7. Sustainability

8. Inclusiveness

9. Reliability
AI systems must perform consistently and predictably under expected operating conditions. 10. Governance
Organizations must establish internal governance structures — policies, processes, roles, and oversight mechanisms — specifically for AI. This is the meta-principle: without governance infrastructure, the other nine principles remain aspirational. FDPL Compliance for AI Systems
Federal Decree-Law No. 45/2021 on the Protection of Personal Data (FDPL) came into effect on January 2, 2022, with a grace period that ended in early 2023. It is the UAE's first comprehensive federal data protection law and applies across all seven emirates — though DIFC and ADGM maintain their own data protection regimes (more on that below).
Consent and Lawful Basis
The FDPL requires explicit and unambiguous consent for personal data processing unless another lawful basis applies. For AI training data, this creates a specific challenge: organizations must demonstrate that the personal data feeding their models was collected under a lawful basis that covers the specific AI use case. Consent obtained for "service improvement" may not stretch to cover training a machine learning model that makes automated decisions about individuals.
Data Minimization
Article 5 of the FDPL requires that personal data processing be limited to what is necessary for the stated purpose. In AI contexts, this directly challenges the common practice of ingesting broad datasets to improve model accuracy. If you cannot demonstrate that each data field in your training set is necessary for the stated processing purpose, you have a compliance gap.
Cross-Border Data Transfers
The FDPL adopts an adequacy-based model for cross-border transfers of personal data. Data may be transferred outside the UAE only to countries or territories deemed to provide adequate data protection by the UAE Data Office, or where appropriate safeguards (such as standard contractual clauses, binding corporate rules, or explicit consent) are in place. Data Subject Rights
The FDPL grants data subjects rights to access, rectify, erase, restrict processing, and port their personal data. For AI systems, the right to erasure is particularly consequential: if a data subject requests deletion of their data, can you actually remove their data from a trained model? Most organizations cannot. This requires either technical solutions (machine unlearning, retraining) or clear documentation of the limitations and the legal basis for continued processing.
Data Protection Officer Requirements
Organizations that process personal data on a large scale or that process sensitive data are required to appoint a Data Protection Officer. The DPO must have sufficient authority, resources, and independence to fulfill their oversight role — and must be involved in AI governance decisions that affect personal data.
DIFC vs ADGM vs Mainland: The Multi-Regime Challenge

The practical consequence: a single organization operating across Dubai mainland, DIFC, and ADGM may need to comply with three separate data protection frameworks simultaneously, each with its own supervisory authority, notification requirements, and enforcement powers. Financial Services (DFSA and FSRA)
The Dubai Financial Services Authority (DFSA, operating in DIFC) and the Financial Services Regulatory Authority (FSRA, operating in ADGM) both have active regulatory programs addressing AI in financial services. AI-driven credit decisions, algorithmic trading, and automated KYC/AML processes face heightened scrutiny.
