Algorithmic Accountability: Who Answers When AI Fails
An automated hiring tool screens out qualified candidates from underrepresented backgrounds. A predictive policing system concentrates enforcement in already over-policed neighborhoods. A health risk algorithm systematically underestimates severity for Black patients because it used healthcare spending as a proxy for health need.
Each one happened. And each time, the same question surfaced: who is accountable?
Algorithmic accountability is the principle that organizations deploying automated decision systems should be answerable for those systems' outcomes — not the outcomes they intended, but the outcomes that actually occurred. It encompasses the obligation to explain decisions, demonstrate systems were tested for harm, provide recourse to affected people, and accept responsibility when systems cause damage.
The Accountability Gap in AI Systems
Traditional accountability assumes a clear chain: a person decided, the decision caused harm, that person bears responsibility. Algorithms break this in several ways.
Distributed development. A deployed system involves data teams, model builders, product integrators, deploying organizations, and infrastructure vendors. When discriminatory outcomes emerge, which link is accountable?
Emergent behavior. ML models learn patterns from data rather than following explicit rules. A model can produce biased outcomes without anyone programming bias — it was in the training data, feature choices, or optimization objective.
Opacity. Many production models — deep networks, large ensembles, transformers — resist interpretation even by their builders. When you can't explain why a model decided something, traditional accountability strains. AI transparency requirements exist to address this, but transparency alone doesn't create accountability.
Temporal distance. A model trained on historical data embeds past biases. Decisions made years ago about data collection and labeling shape outcomes today. The people who made those decisions may no longer be at the organization.
NYC Local Law 144: Accountability for Employment Decisions
New York City's Local Law 144, effective July 5, 2023, targets automated employment decision tools (AEDTs) — systems using ML or AI to evaluate candidates for employment or promotion.
Mandatory bias audits. Employers using AEDTs must obtain an independent bias audit within the past year, assessing disparate impact by race, ethnicity, and sex. Results must be publicly available.
Notice requirements. Candidates must be notified at least ten business days before an AEDT evaluates them, including what qualifications the tool assesses, data sources, and retention policies. Candidates must be offered an alternative process where available.
Enforcement. The NYC DCWP can impose $500-$1,500 penalties per violation per day.
The law has real limitations — it only covers employment decisions in NYC, only audits for race/ethnicity and sex, and doesn't rigorously define "independent auditor." A December 2025 state comptroller audit found enforcement gaps. Still, Local Law 144 established a critical precedent: the burden of proving an algorithm doesn't discriminate falls on the deployer, not the affected individual.
EU AI Act: Chain-of-Responsibility Accountability
The EU AI Act establishes accountability across the entire AI value chain — not just employment, but healthcare, education, law enforcement, and critical infrastructure.
Providers bear the heaviest obligations: quality management systems, conformity assessments, technical documentation, human oversight capabilities, and registration in the EU database under Article 49.
Deployers must use systems per instructions, ensure human oversight, monitor operations, and report serious incidents. They can't deflect to the provider — they carry independent obligations.
Importers and distributors must ensure systems entering the EU market meet requirements regardless of origin.
Penalties reach 35 million euros or 7% of global turnover for prohibited AI practices, and 15 million euros or 3% for other violations. The risk-based approach means accountability scales with consequence, consistent with the NIST AI RMF.
Closing the Gap: What Accountability Looks Like Operationally
Organizations that establish real accountability do five things.
Assign ownership at the system level. Every AI system in your inventory needs a named accountable owner with authority over deployment, modification, and retirement.
Document decisions, not just models. AI audits examine decisions: why was this data selected? Why was this fairness metric chosen? Why was this disparity deemed acceptable? Undocumented decisions can't be reviewed or defended.
Test before deployment, monitor after. Pre-deployment bias testing is necessary but insufficient. Models drift. Continuous monitoring with automated alerting catches degradation that point-in-time testing misses. The EU AI Act requirements guide details post-deployment monitoring obligations.
Provide recourse. Affected individuals need notice that an automated system was involved, explanation of influential factors, and access to a human reviewer who can override the system.
Maintain audit trails. When a regulator asks "what happened and why," answer with evidence. Immutable logs of model versions, inputs, outputs, and human overrides form the evidentiary backbone.
The Regulatory Direction
Accountability regulation is expanding. Colorado's AI Act introduces developer and deployer duties for high-risk systems. The CFPB requires lenders using AI to provide specific adverse action reasons. Government agencies face growing executive orders requiring algorithmic impact assessments.
The trajectory is clear: voluntary accountability is becoming mandatory. Organizations that build accountability infrastructure now invest in compliance readiness. Those waiting for regulatory clarity will retrofit under deadline pressure — always more expensive and disruptive.
